Sentencing Guidelines Not Tramlines

Sentencing Guidelines for an offence are just that: guidelines not tramlines. Courts do not have to pay wholly rigid adherence to them and there will be occasions when an offence can properly be categorised as falling in a lower or higher bracket. The guidelines have an element of flexibility in them and all the circumstances must be taken into account.
